Woman fired for 'being too cute'

Earlierthis week, an American appeals panel overturned a lower court ruling thatclaimed employees cannot be fired because of their gender - however they can befired for "being too cute". 

Theruling comes after a massage therapist filed a lawsuit against her former boss,a Wall Street chiropractor, after he fired her for allegedly being "too cute".Dilek Edwards was told by her former boss, Charles Nicolai, that his wife maybecome jealous if they pair worked together. 

Theeclectic case sheds light on the issues surrounding what constitutes a claimfor wrongful termination, specifically how HR should intervene in cases such asthis one. We spoke to Beverley Sunderland, Managing Director at CrosslandEmployment Solicitors, who detailed how an employer should be acting inaccordance to the law, if this were to have occurred in the UK. 

"Ifan employee with more than two years' service is dismissed it must be for afair reason," she said. "Redundancy, conduct, capability, illegality or someother substantial reason. If a woman is dismissed simply for being veryattractive then this is unlikely to fit into any of these categories,especially as she was likely to have been attractive when she was recruited inthe first place. 

"However,even if she does not have two years' service her other claim is that this isless favourable treatment because of her sex, as it is unlikely that anattractive man would be dismissed in the same circumstances."
